Planning permission has been refused for this proposal for the clear reasons set out in this decision notice. In the Council’s view the proposal is unacceptable in principle and the fundamental objections cannot be overcome through dialogue. The applicant was invited to withdraw the application to seek pre-application advice prior to any re-submission but did not agree to this. The Council has therefore complied with the requirements of the Framework (paragraphs 186 and 187) and in accordance with the Town and Country Planning (Development Management Procedure) (England) (Amendment No. 2) Order 2012.
The Council as the Local Planning Authority hereby gives notice of its decision to REFUSE PERMISSION for the development specified above and as shown on the submitted plans, for the following reason:
The brown coloured weatherboarding, due to the type of finish, contrasts starkly with the brick finish of the adjoining and neighbouring properties. The property is in a prominent location open to public view and as such is detrimental to the character and appearance of its surroundings. The proposal is therefore contrary to Policies CS14 and DM3 of the Central Bedfordshire Development Management Policies (2009) and guidance in Design in Central Bedfordshire (2014).
This decision was appealed. The appeal was lost and the cladding will need to be removed.

2. All external works hereby permitted shall be carried out in materials to match as closely as possible in colour, type and texture, those of the existing building.
Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to match/complement the existing building(s) and the visual amenities of the locality.
3. Notwithstanding the submitted plans, prior to first occupation of flat 3 the first floor window in the west, side elevation of the development hereby permitted shall be fitted with obscured glass of a type to substantially restrict vision through it at all times where the window height is less than 1.7metres above the floor level in the room where the window is installed. No further windows or other openings shall be formed in the elevation.
Reason: To safeguard the amenities of occupiers of adjoining properties.
4. Prior to occupation of any flat the vehicle access, parking and turning areas within the site shall be laid out in accordance with the approved details, unless an alternative layout is agreed in writing with the Local planning Authority, and thereafter retained for those purposes.
Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and the premises.
5. Before the premises are occupied all on site vehicular areas shall be surfaced in a stable and durable manner in accordance with details to be approved in writing by the Local Planning Authority. Arrangements shall be made for surface water drainage from the site to soak away within the site so that it does not discharge into the highway or into the main drainage system.
Reason: To avoid the carriage of mud or other extraneous material or surface water from the site so as to safeguard the interest of highway safety and reduce the risk of flooding and to minimise inconvenience to users of the premises and ensure satisfactory parking of vehicles outside highway limits
6. Prior to the occupation of any flat the cycle storage and the bin storage area shall first be provided in accordance with the approved details, unless an alternative layout is agreed in writing with the Local Planning Authority, and shall thereafter be retained for such purposes.
Reason: To ensure the provision of adequate cycle parking and refuse storage to meet the needs of future occupiers of the development and to encourage sustainable modes of transport.
7. Notwithstanding the submitted block plan no development shall begin until a landscaping scheme to include planting within a brick planter (the detail of which shall also be submitted for approval) and hedging around the bin storage area and along the east boundary of the site has been submitted to and approved in writing by the Local Planning Authority. The approved scheme which shall include detail of plant species, size and density shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season means the period from October to March). The planting shall subsequently be maintained for a period of five years from the date of planting and any which die or are destroyed during this period shall be replaced during the next planting season and maintained until satisfactorily established.
Reason: To ensure a satisfactory standard of landscaping to screen the parking area and refuse storage, in the interests of visual amenity.
8. The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers [10.041.16L, 1041.15E, 10.41.OSmap].
Reason: For the avoidance of doubt.
There is currently an enforcement notice issued by Central Beds to stop work on the outside of the building and requiring the black cladding and rendering to the outside of this property to be removed.

Reasons given:
1. The proposed conversion of a four bedroom dwelling to 13 residential apartments would result an unsustainable form of development given the location of the site which lies outside of any defined Settlement Envelope and isolated from public transport links and community facilities. This would be contrary to the National Planning Policy Framework (2012) and Policy DM4 (Development within and Beyond Settlement Envelopes) of the Core Strategy and Development Management policies (2009).
2. The proposal, given the siting and design of the dwellings, is considered to result in an adverse impact upon the amenities of the future occupiers. The applicant has failed to demonstrate that the proposal would not result in significant impact from noise and fumes from the adjacent Andersons Transport Haulage/Horticultural business which would result in adverse loss of amenity to future occupants of the properties. The proposal is therefore considered to be contrary to Policy DM3 (High Quality Development) of the Core Strategy and Development Management Policies Document (2009)
3. The proposal would result in a significant increase in traffic to and from the premises. The access is located immediately adjacent to the side of No 53 Blunham Road and therefore the increase in traffic would result in an adverse impact upon amenities of this neighbouring property by way of unacceptable noise and disturbance in a rural location. The proposal is therefore contrary to Policy DM3 (High Quality Development) of the Core Strategy and Development Management Policies Document (2009).
4. The application contains insufficient information in the form of a completed S106 Agreement in order to secure financial contributions towards infrastructure in the local area and mitigate the impact the proposal would have on community facilities and infrastructure and secure Affordable Housing provisions from the development; as such the proposal is contrary to Policy CS2 (Developer Contributions) and Policy CS7 (Affordable Housing) of the Central Bedfordshire Council Core Strategy and Development Management Policies Development Plan Document (2009) and the Central Bedfordshire Council Planning Obligations Supplementary Planning Document (Reviewed November 2009).
Included in the application is the building of a 22 space car park to the West of the property.
This application was discussed in detail at the recent MATHS meeting and we are concerned. We strongly urge residents to write to CBC objecting to this application. The consultation period closes September 22. These are some of the significant reasons for objecting to this application.
Communication from a parishioner:
‘Folk living in Blunham Road will have seen many large lorries full of earth/topsoil being moved from 6 Bedford Road to 95 Blunham Road. Central Beds enforcement team visited 95 Blunham Road at the start of last week but seemed unconcerned with what is happening, seeing it as "landscaping" work that is being carried out, as no building work had been started. Planning permission is not required for landscaping.
Whilst they have uprooted their trees and front hedge adjoining the footpath, they have installed a new fence, although this fence is made up of plywood sheets (similar to a building site!) and does not look pretty, they have not done anything against planning regulations.
The planning permission granted for 6 Bedford Road CB/13/01311/full has the following condition attached:
There does not appear to be a wheel cleaning facility there so it is only by good fortune that the amount of activity this week has been in good dry conditions, otherwise you can imagine the amount of mud deposited on the A603.
The scheme is totally out of keeping with the local street scene, will be three stories high and will allow overlooking of No's 53, 34, and 36 Blunham Road. This has the capacity for doubling the current population of Chalton from this one building and there will be great dangers of so many cars from a 22 space car park situated in the middle of this small hamlet, and crossing a public footpath to gain access to the highway on a 90 degree bend. The accommodation space is so small in all of these flats that they are likely to be used for short term let only and social housing. There will be no outside space for any children, except to play in the street. You can see from the general destruction of the site already, before planning permission has been granted, that the visual amenity of this corner will be severely altered and create an eyesore with such a massive outline of the building. There are currently no planning permissions which allow any development to the west of the property where the extensive landscaping is taking place.
I hope as many people in Chalton and Moggerhanger will be able to write objection letters against this scheme.’

Two previous applications were made. The first was withdrawn and the second one was not approved by CBC. Details of both applications cab be seen at CB/12/03143/FULL (withdrawn) and CB/13/01869/FULL (not approved). There is a little more information on both of these applications here
So that you can follow more easily what’s been happening on this application this section has been rewritten so that all events are in chronological order.
The Parish Council called an open meeting on June 16 at 7.30pm in the village hall to discuss this application.
Mr Harry Hughes, the architect involved in the above application was present to provide an overview of the development and to answer questions. There were approx. 20-25 parishioners present.
The main points raised were:
Throughout the meeting it became apparent that Mr Hughes was unable to answer many of our questions. He maintained that any issues would be addressed by the various authorities (Central Beds, Highways, Anglian Water etc.) and where issues arose they would be dealt with by a series of conditions placed upon any grant of approval given. Mr Hughes said they were obliged to comply with all the conditions as part of the development and therefore all issues would be dealt with. There was great concern that the issues raised would not be addressed until after planning had been granted and then what assurance did we have that they would be addressed appropriately if at all.
The Parish Council were supportive of the concerns raised by the parishioners and will be writing to the planning department to raise these concerns.
We have contacted Anglian Water who have received a reply stating they do not believe the additional houses will cause a problem.
Everyone is greatly concerned that not one of the significant issues raised by the parishioners has been taken into account by Central Beds Planning or any of the other authorities.
In support of your Parish Council please write to Central Beds objecting to this application (put objection in large bold letters at the top of you communication) stating all the reasons given above and indeed any others that you have concerns about.
Also please write to Anglian Water. There are problems with water pressure and mains drainage that show the system already to be inadequate. This can only get worse.The DMC will consider the application on 27 Aug 14. The CBC case officer, Amy Lack, has recommended the application for approval. It is therefore vitally important for as many parishioners as possible to attend the Development Management Committee meeting at 10 a.m. on August 27 at the Council offices at Chicksands. A public meeting took place on Sunday 29 Jun 14 in the Village Hall at 2 p.m. chaired by Prof Richard Parish. He presented new information he had received from CBC , The Highways Authority and Anglian Water. You can read the minutes of the meeting here. The meeting agreed to form a Moggerhanger action group. Team members are Mr Lawrence Ashbridge, Mr Chris Bashford, Mr Jean-Pierre Brun, Mrs Carolyn Lister, Prof. Richard Parish, Mr Paul Petrie and Mr Chris Smith.

The Moggerhanger action group met again on 9 Jul 14. Amongst other matters it was agreed that Paul Petrie, Chairman of the Parish Council and a member of the group, would make a three minute presentation at the Development Management Committee meeting for which he would obtain the full agreement of the Parish Council. It was also agreed that Richard Parish would speak for the parishioners and that he two would give a three minute presentation. The content of both presentations would be coordinated for maximum impact. The minutes of the meeting can be read here. The third meeting of the Moggerhanger action group took pace on 22 Jul 14. It decided that it would adopt the name Moggerhanger Acting Together for Housing and Safety (MATHS). Paul Petrie, Chairman of Moggerhanger Parish Council, left the group in the interests of impartiality. It was agreed to invite William Hollington to join the group as Chalton was not yet represented. Mr Max Hill, Chairman of Governors of Moggerhanger Lower School has agreed to make a presentation to the DMC. The meeting covered many other points of action and coordination. There has been much discussion in the parish about the voting which took place at the DMC meeting on 27 Aug 14. A parishioner has received the following clarification from Tricia Turner:
‘At the planning comm. when this application was discussed the first proposition was to approve the app. subject to an additional condition requiring the re-siting of the picket fence at the front of the pub.
Having been moved and seconded this motion was put to the vote and was lost.
Following considerable discussion a second motion was put to defer the application for two cycles to enable further officer discussions with the applicant to consider the possibility of affordable bungalows ie a re-think of affordable housing options on the site.
This motion was proposed and seconded and succeeded when put to the vote.
Officers in the housing dept. are now in the process of establishing the evidence as proof of the committee’s request to put to the applicant.’

Carolyn Lister reported on behalf of MATHS:
“Last week Richard Parish, Chris Smith and myself met with CBC, Cllr Nigel Young (Portfolio holder for housing), David Lamb (Head of Planning) and Cllr Tricia Turner to discuss the development behind the Guinea.
They were sympathetic to our concerns but firm on the following points:
That said we had a long discussion on the water issues and CBC were very concerned. We stressed the contents of their own documents back in 2008/9 where Anglian Water had identified problems. There has been no upgrade in the sewage system and only a marginal improvement in water supply so the situation can only get worse.
Since 2005 there have been 12 new dwellings in Moggerhanger; current approvals will add a further 11 and this application a further 18 that’s a total of 41 in a ten year period, approx. 20% increase with no improvements in infrastructure or provision of any new facilities.
We convinced CBC there is a serious issue and they have agreed to talk to Anglian Water and even send their own engineers to assess the situation. Meanwhile MATHS is gathering further evidence to support our claims. If our claims are upheld then CBC would not allow the development to proceed without the water situation being sorted.
It is vitally important we have a good turnout for the next DMC meeting on Wednesday, November 19 so please confirm to me if you are able to attend and I will organise transport as before.”

Once again the report concluded that water supply and disposal are adequate. With regard to the road the report contains conditions to reposition the give way markings at the junction of Blunham Road and the A603 and the repositioning of the Guinea picket fence to improve visibility.

Update from the Central Beds DMC meeting November 19.
Firstly thanks to everyone who turned out on the day to support we had 40 people there.
Richard Parish delivered a superb presentation, highlighting all of the issues we have with the A603, including noise and volume of traffic, also the issues with Anglian Water, including poor water flow and waste water disposal. This was echoed by our District Councillor Tricia Turner who was incensed that in 2014 we could have such poor services in the village.
There was much discussion and a general feeling that Anglian Water were disingenuous in their statement that the water supply and disposal are both adequate. One councillor even went as far as to say he did not believe anything that Anglian Water said.
The A603 was also discussed with promises to review the CBC Local Transport Plan. Sadly this is not the answer, see below one of the comments MATHS sent to CBC prior to the DMC meeting. The plan already designates the A603 for deliveries and access only, so just needs to be implemented.
“The traffic issues relating to the A603 are further emphasised in the recent Central Bedfordshire
Local Transport Plan covering Sandy, Biggleswade and the surrounding area. This
clearly states that the A603 is designated a “Secondary Freight Route” for “access
and deliveries” (p 35 of the Local Area Transport Plan, 2013).”
Despite much discussion the conclusion at the end of the day was that this application did not significantly impact on either of these main issues. So despite overwhelming evidence provided to them the DMC chose to ignore resident’s concerns and has approved the application.
In the last decade there have been a number of new properties built and with current planning approvals plus this latest 18 the total number of new properties will total 41. That is approximately a 20% increase with no improvement in infrastructure and more traffic on the A603.
MATHS will be notifying Central Beds of its intent to lodge a formal complaint siting the following as the basis of that complaint:
A failure to consistently apply policy and criteria
A failure to respond appropriately to the concerns and complaints of residents
Inadequate or inappropriate consultation in relation to the criteria used to inform a policy (the LDF) used subsequently to justify approval of The Guinea Planning Application
A failure to follow the Authority’s own procedures and guidance
Nobody has said we are against development in the village but it must be with the appropriate/continued improvements in infrastructure.
We are resolved to getting these issues dealt with to ensure the quality of life in Moggerhanger is not constantly eroded.

The enforcement notice/appeal documents on CBC website cannot be linked to directly in the same way that planning applications can. You will be aware of the Andersons Transport application for change of use to the grain store. As you know an enforcement notice EN4 was issued by CBC planning on November 20, 2013, coming into effect on December 20, 2013. This notice required the removal from the grain store of all equipment and materials associated with the haulage business, the removal of vehicles connected to the haulage business from the grain store and surrounding land, and any use of the grain store in connection with the haulage business to cease.
Andersons Transport have appealed against this enforcement notice. The appeal will be dealt with by The Planning Inspectorate by Written Representation. The closing date for letters to the Inspectorate is 19 February 2014.
MPC intend to write to the planning inspectorate forwarding their communication used at the public enquiry last year. They fully support CBC’s enforcement notice.

Following the enforcement notice EN4 mentioned above an appeal was submitted by the applicant which was heard in January 2015.
The appeal has been dismissed by the Government's Planning Inspector and the enforcement notice has been upheld on behalf of the council. Anderson’s transport now have 3 months from January 12 to comply with the enforcement notice.
The inspectors full written decision is here but in summary this means that by April 12 they must:-
1) Remove all materials, equipment and fixtures and fittings including trolleys and racks that are stored on the Land and in the grain store building in connection with the haulage business use.
2) Remove from the Land all vehicles that are stored or parked on the Land or in the grain store building in connection with the haulage business use.
3) Cease using the Land and grain store building for the storage, delivery and distribution of materials, including plants, in connection with the haulage business use.
4) Cease using the Land and grain store building for parking and storage of vehicles in connection with the haulage business use.
Mr Anderson asked for costs to be awarded to him but the Inspector rejected his request. You can read the Inspectors decision here.

Change of use of the existing grain store building to a mixed use grain store and haulage (Use Class B8)
At the Parish Council meeting 15 Jan 14 an overview was given of this application identifying elements described in the combined planning design and access document supplied by Andersons Transport as part of their application. Namely, to allow more flexible use of the building, the building would be used to provide some storage for haulage purposes, this would have no knock-on effect in terms of vehicle movement, this would have no material impact on the living conditions of the neighbours.
No mention was made of enforcement notice 4 issued by CBC planning on November 20, 2013, coming into effect on December 20, 2013. This notice required the removal from the grain store of all equipment and materials associated with the haulage business, the removal of vehicles connected to the haulage business from the grain store and surrounding land, and any use of the grain store in connection with the haulage business to cease. After some discussion the PC voted 5 to 4 against this planning application. Refused by CBC on 14 Feb 14 for the following reasons.

Change of use from agricultural to D1, larger outbuilding to be used as an exhibition area, smaller outbuilding to be used for practical teaching workshops related to agriculture and horticulture.
You may remember that this application was submitted and discussed in September I believe. There were a number of issues and it was suggested the application be withdrawn and resubmitted. You can see what happened previously here but here are some notes from the September meeting:
A Mr Stamford made representation regarding the application and outlined it’s intended purpose. Mr Stamford is living at Park Farm and has cleared away the broken glass from the greenhouses and generally tidied and made the area safe.
The outbuildings are to be converted to workshops (metalwork and woodwork) and classrooms. Mr Stamford intends to provide tuition to disadvantaged youths under the age of 16 in horticultural methods and practices.
Parishioners raised concerns over noise.
Mr Stamford stated that classes would run from 9.30am until 3.30pm Monday to Friday and not on the weekend. The application stated 9am to 5.30pm Monday to Saturday. Mr Stamford said the application was incorrect, that he was not responsible for its submission, and promised no classes would be run on the weekend.
Parishioners raised concerns over increased traffic. Mr Stamford stated that classes would be for no more than 6 pupils. A specific incident was cited that earlier this year a summer camp was held and that Park Road was completely blocked by traffic for some time whilst children were dropped off and gear unloaded.
Parishioners raised concerns that no discussion had taken place with local residents, that the only communication had been the open day (last year?). Mr Stamford said he had communicated through various public avenues to inform people of their plans. In discussion it appears Mr Stamford has spoken at their volunteer days and also gave a talk at a Moggerhanger Gardening Club meeting. It was suggested to him that these did not constitute public meetings.
The revised application appears to have less information than before with no mention of times or numbers of ‘pupils’. The PC had a short discussion and voted to approve this application although wanted to bring to the attention of CBC planning concerns over damage to verges. There was no mention of other concerns raised. Consultation closes February 7, 2014 and letters should be addressed to Nikolas Smith.

Erection of canopy and lights to grain store.
This application was discussed at length at a Planning Committee meeting on 18 Dec 13. Considerable concerns were raised by the Parishioners. Nobody could understand why a grain store would require lighting. It was brought to the PCs attention that the grain store was in fact being used as part of the Anderson’s haulage business, for which they do not have permission.
It was further highlighted that the grain store was subject to an enforcement notice EN4 requiring this incorrect use to cease. It is quite difficult to find as it is filed with the other enforcement notices issued dating back to 2011 (CB/ENC/11/0267). Despite this, and the fact that a number of Councillors were not in favour of supporting this application, the overall decision of the PC was in favour with a comment that lighting times could be subject to conditions.
The consultation period for this application has been extended until Thursday of this week 9 Jan 14. If you wish to comment on this application you can do so online to ensure you meet the deadline.
12 Feb 14 - we understand that the external lighting element of this application has been removed.
This has now been approved by CBC.

Erection of a ground floor front extension, first floor front & side extensions and part one & two storey rear extension, loft conversion and external alterations.
This was also discussed at length at a Planning Committee meeting on 18 Dec 13 and again approved by the PC. Parishioner concerns centred around the almost doubling in floor area which was felt to be not in keeping with the surrounding properties. The consultation period for this application expired 2 days after the PC meeting.
Permission granted by CBC 24 Jan 14.
